The data subject is a natural person who provided his or her personal data to the controller under a lease agreement, purchase agreement, service agreement or other agreement, concluded with the controller on the basis of explicit consent to the processing of personal data or the consent to the processing of personal data within the subscription to the newsfeed (newsletters) sent by the controller. The data subject may also be a natural person whose personal data the controller has obtained from other legal sources.

The extent of personal data processing

The controller processes the personal data to the extent in which the subjects´ data are provided to it, or to the extent the controller obtains it from other legal sources. This concerns: name, surname, date of birth, place of residence, place of business, name of the subject, identification number, credit card number, tax identification number, bank number, e-mail, telephone, signature.

The purpose of personal data processing

The controller processes the personal data of the data subjects in accordance with the Regulation of the European Parliament and of the Council 2016/679 of 27 April 2016 on the Protection of individuals with regard to the processing of personal data and on the free movement of such data and on the repealing of Directive 95/46/EC (General regulation on the protection of personal data), (hereinafter referred to as the "Regulation") in order to fulfil the obligations under the contract concluded between the data subject and the controller or to submit information in the form of electronic means of communication remotely or in writing, to fulfil the legal obligations and for the purpose of direct marketing (i.e. the offering of products and services of the controller), including the sending of business messages within the meaning of Act No. 480/2004 Sb., on certain services of the information company. The business message shall be sent by the controller only if the data subject has subscribed to the newsfeed (newsletters) or if the controller has obtained the details of the electronic contact of the data subject in connection with the sale of his or her products or services. The data subject has the possibility to unsubscribe from the newsfeed (newsletters) simply and free of charge.

Assessment of the necessity of processing

The controller takes care to protect the privacy of data subjects in accordance with the regulation and therefore it only processes personal data that are strictly necessary for the intended processing purposes.

Legal basis for the personal data processing

The legal basis for the processing, carried out for the purpose of direct marketing, is the consent of data subjects with the processing of personal data (subscription to newsletters) or the legitimate interest of the controller (obtaining electronic contact in connection with the sale of the product or the service of the controller pursuant to Act No. 480/2004 Sb.).

In other cases, the legal basis for the fulfilment of the contract is the protection of the legitimate interests of the controller (protection of property, exercising the contractual rights in the court proceedings, etc.) and the fulfilment of a legal obligation.

The period of personal data processing

In the case of personal data, processed for the purpose of fulfilling the contract, the controller processes the personal data for the duration of the contractual relationship and subsequently for an additional period of 10 years, considering the length of the limitation period for loss and damage. In case of processing in order to fulfil the legal obligation, the controller processes personal data for the period stipulated by the legal regulations. In case of personal data processed on the basis of the data subject's consent, the controller processes personal data within the period of 10 years, unless the consent to the processing of personal data has been withdrawn by then. This shall not affect the obligation of the controller to process personal data for a period of time determined by or in compliance with the relevant legislation.

Revocation of consent to the processing of personal data

If the data subject has given the controller the consent to the processing of personal data, he or she may at any time recall his or her consent to the processing of personal data free of charge. The revocation of the consent shall not affect the lawfulness of processing based on the consent given prior to its revocation. The revocation of the consent shall also have no effect on the processing of personal data, processed by the controller on the basis of a legal basis other than the consent (i.e., in particular, if the processing is necessary to fulfil the obligations under a contract, legal obligations or for other reasons stated in the applicable legislation).

Access to personal data

The personal data of data subjects are accessible by the administrator and, where applicable, also by third parties - recipients who provide appropriate warranties and whose processing complies with the requirements of applicable law, ensuring the adequate protection of data subjects' rights.

Other rights of the data subject

The data subject also has the right within the regulation to request information on which of his or her personal data are being processed, to request a list of subjects which have access to his or her personal data, to request access to his or her personal data and to have them updated or corrected, to request the deletion of personal data and, finally, in case of any doubt regarding compliance with the obligations related to the processing of personal data, to contact us or the Office for Personal Data Protection.
